Key historical landmark research malpractice scandals that shocked the international community were the origin of the institution of ethics review prior to carrying out research involving humans. Nonetheless, it is plausible that unethical research is ongoing or may have been conducted in recent times that has escaped public notice, especially in the vulnerable low- and middle-income country contexts. The basic constitution of these committees at some point has not been clearly defined, with most scientists declaring political maneuvers at times. These (...) committees today are characterized by bureaucratic bottlenecks, financial interests, inadequate training in research ethics, and lack of control and coordination of their functions. Treatment informed consent aims to preserve the autonomy of patients in the clinician – patient relationship so as to ensure valid consent. An acceptable method of evaluating understanding of consent information is by assessing the extent of recall by patients of the pieces information believed to have been passed across. When concerns are not satisfactorily addressed from the patients’ perspective, recall of consent information may be low. This study is a questionnaire – based cross – sectional interview of consecutive adult (...) surgical patients who could give their respective medical histories and who were booked for elective major surgical procedures over a period of 7 months in a tertiary health institution in southeastern Nigeria. Four to five days after a formal consent session, during ward admission, extent of recall of information on the nature of the disease condition or diagnosis, the nature of the planned procedure and the risks involved in the planned procedure were assessed and analyzed on the background of how satisfying the consent sessions were from individual patient’s perspective. Generally, the recall of nature of disease condition and nature of planned procedure is better than recall of risks involved in the planned procedure. More specifically however, recall in these 3 domains is significantly better among the patients that affirmed that their concerns were satisfactorily addressed. The findings from this study support that no effort should be spared in ensuring that the consent information are satisfying to the patients from the patients’ viewpoint. (shrink)

An important, but relatively neglected, aspect of human theory of mind is emotion inference: understanding how and why a person feels a certain why is central to reasoning about their beliefs, desires and plans. The authors review recent work that has begun to unveil the structure and determinants of emotion inference, organizing them within a unified probabilistic framework.

In the transcendental aesthetic of the Critique of Pure Reason, Kant claims that space and time are neither things in themselves nor properties of things in themselves but mere subjective forms of our sensible experience. Call this the Subjectivity Thesis. The striking conclusion follows an analysis of the representations of space and time. Kant argues that the two representations function as a priori conditions of experience, and are singular "intuitions" rather than general concepts. He also contends that the representations underwrite (...) some non-trivial a priori cognition of the objects of sensible experience. The Subjectivity Thesis is then presented as an immediate consequence: Space represents no property at all of any things in themselves nor any relation of them to each other. . . . For neither absolute nor relative determinations can be intuited prior to the existence of the things to which they pertain, thus [neither] can be intuited a priori. Time is not something which exists of itself, or which inheres in things as an objective determination. . . . [Were it] a determination or order inhering in things themselves, it could not precede the objects as their condition, and be known and intuited a priori by means of synthetic propositions. The spiritual restlessness of millennials rests on a legitimate search that is hardly satisfied by the structure that we find in traditional religions. Yet, the preponderance of ecumenical initiatives in contemporary society means that there are forms of spiritual ecumenical practices that might serve as a solution. Beyond serving the central interest of ecumenism, namely Christian unity, these forms of ecumenical spiritualities may provide spaces for the millennial encounter with the divine in a way that holds their constant spiritual “negotiation” (...) in balance with the need for some form of “habitation” that institutional religion provides. This article investigates how spiritual ecumenism is best suited for responding to the quest of millennials, and it equally provides concrete examples to justify such a claim. (shrink)

Indigenous spiritualities among Africans, both in Africa and in the diaspora, are flourishing. In Lagos, Nigeria, for example, shrines compete with churches and mosques in adherents and positions. Beyond Africa, the rise of African spiritualities has become conspicuous. Reasons range from Afrocentrism to anti-religious tendencies to the popular religions, from racial animosity to politico-economic ideologies, yet insufficient attention is being paid to this new Afro-spiritualities. Can this renaissance in African spirituality bring forth or support a renaissance in Africa? Africa arguably (...) domesticates the future of humanity. From ecological perspectives to the productivity of offspring, from economic potentials to viable youths for the future, Africa must become progressively discursive in the global platform. A good way to indulge in this would be to understand the spirit of Africa, in the traditional spiritualities that constructed orientations and worldviews of the people. Understanding and addressing African spiritualities constitute an important key in understanding the African identity. (shrink)

Darwin hypothesized that some animals, when selecting sexual partners, possess a genuine “sense of beauty” that cannot be accounted for by the logic of natural selection. This hypothesis has been notoriously controversial. In this chapter I propose that the concept of agency can be useful to operationalize the “sense of beauty”, and can help identify the conditions under which one can infer that animals are acting as (aesthetic) agents. Members of a National Health Service, or other recognised Research Ethics Committee, in deciding whether or not to withhold their assent for a clinical trial, must obey the law. If they do not do so, then they may become liable to pay personally negligence claims made by injured trials subjects. It could be no defence to say that members had consulted their own lower ethical standards; or merely that they had acted in good faith; or that they had followed Department (...) of Health guidelines, which do not have the force of law. The law requires that the rights, safety, and well-being of clinical trial subjects shall prevail over other interests. REC favourable opinion is a powerful endorsement of a trial, and prospective subjects are invited to rely upon it. REC members are legally bound to exercise their power to withhold assent to any clinical trial which does not give subjects the protection the law requires. (shrink)

This is a series of reflections on the aesthetic dimensions of law (how it is presented and conveyed to its subjects) and justice (the ways in which justice can be aesthetically satisfying or dissatisfying).

Incongruent counterparts are pairs of objects which cannot be enclosed in the same spatial limits despite an exact similarity in magnitude, proportion, and relative position of their parts. Kant discerns in such objects, whose most familiar example is left and right hands, a “paradox” demanding “demotion of space and time to mere forms of our sensory intuition.” This paper aims at an adequate understanding of Kant’s enigmatic idealist argument from handed objects, as well as an understanding of its relation to (...) the other key supports of his idealism. The paper’s central finding is that Kant’s idealist argument from incongruent counterparts rests essentially on his theory of freedom. The surprising result sheds new light on deep and overlooked links among the pillars of transcendental idealism, pointing the way to a comprehensive and unified reading of Kant’s system of idealist arguments. ABSTRACT Academic dishonesty has been found to be on the increase globally, affecting the quality of education, ethics of professional practices and career outcome. Substantial literature exists on the role of religious commitment in reducing academic dishonesty, but few or no studies have examined the pathways explaining this link. The present study examined whether self-efficacy mediates the relationship between RC and AD. Undergraduates of the University of Nigeria, Nsukka completed the Academic Dishonesty Scale, Religious Commitment Inventory and New General Self-Efficacy (...) Scale and also provided relevant demographic information. Results of statistical analysis indicated that RC was negatively associated with AD. Self-efficacy was also a partial mediation in the relationship between RC and AD. This implies that self-efficacy contributes to the pathways through which RC influences AD among students. Our findings suggest that consideration of students’ level of self-judgment on their ability to cope with academic demands may be an important target toward enhancing the influence of RC in reducing academic dishonest behaviors among students. The relationship between tort law jurisprudence and the ethics and phenomenology of Emmanuel Levinas.

A central doctrine of Kant's Critique of Pure Reason holds that the content of human experience is rooted in an affection of sensibility by unknowable things in themselves. This famous and puzzling affection doctrine raises two seemingly intractable old problems, which can be termed the Indispensability and the Consistency Problems. By what right does Kant present affection by supersensible entities as an indispensable requirement of experience? And how could any argument for such indispensability avoid violating the Critique's doctrine of noumenal (...) ignorance? This essay develops a new solution to both problems, setting out from the continuity between Kant's early and mature views on sensibility and mind-world relations. Kant's early writings subscribe to an interactionist cosmology opposed to both Leibniz's preestablished harmony and Malebranche's occasionalism. The modern debate on mind-world relations shaping Kant's early cosmology points us to a widely recognized motivation for interactionism, turning on a constraint on agency within certain noninteractionist cosmologies. In particular, Kant's early conversion to a libertarian theory of freedom, together with his rejection of occasionalism, provides the basis for a compelling argument for the indispensability of world-mind affection relations. Extended to the transcendental idealist framework, the same argument reveals noumenal affection as an indispensable presupposition of some knowledge claims consistently upheld by Kant. This leads in turn to a satisfying solution to the Consistency Problem, showing that the doctrine of noumenal affection is not merely consistent with, but is partly motivated by, Kant's commitment to noumenal ignorance. Hegel is perhaps the modern philosopher par excellence of mediation, and his criticisms of doctrines of immediacy are worthy of consideration. I see his mediation as following a logic of self-determination, and this, even when his views are clearly open to an acknowledgement of the other to self. By contrast to Hegel’s self-determining dialectic, I offer an account of immediacy and mediation, and their interrelation, in light of a metaxological conception of being. This concept ion asks for the invocation of (...) a surplus givenness that is not the opposite of mediation, but rather than a mere indeterminacy, a set of determinations, or an inclusive process of self- determination. I draw on the account I have offered in Being and the Between. I also offer some reflections on how this approach overlaps with, and diverges from some phenomenological treatments of the matter. René Descartes is best remembered today for writing 'I think, therefore I am', but his main contribution to the history of ideas was his effort to construct a philosophy that would be sympathetic to the new sciences that emerged in the seventeenth century. To a great extent he was the midwife to the Scientific Revolution and a significant contributor to its key concepts. In four major publications, he fashioned a philosophical system that accommodated the needs of these new sciences and (...) thereby earned the unrelenting hostility of both Catholic and Calvinist theologians, who relied on the scholastic philosophy that Descartes hoped to replace. His contemporaries claimed that his proofs of God's existence in the Meditations were so unsuccessful that he must have been a cryptic atheist and that his discussion of skepticism served merely to fan the flames of libertinism. This is the first biography in English that addresses the full range of Descartes' interest in theology, philosophy and the sciences and that traces his intellectual development through his entire career. Clarke presents new translations, from French and Latin, of three of the first feminist tracts to support explicitly the equality of men and women: Marie le Jars de Gournay's The Equality of Men and Women, Anna Maria van Schurman's Dissertation, and François Poulain de la Barre's Physical and Moral Discourse concerning the Equality of Both Sexes. These works transformed the language and conceptual framework in which questions about women's equality were subsequently discussed. This edition includes new translations, (...) from French and Latin, of these three feminist authors, excerpts from their related writings, together with an extensive introduction to the religious and philosophical context within which they argued against the traditional view of women's natural inferiority to men. The paper examines Kant’s views on divine foreknowledge of contingent truths, in particular truths concerning free actions of creatures. It first considers the shape this traditional philosophical problem takes in the transcendental idealist context. It then situates Kant’s views relative to three competing theories of foreknowledge discussed by Leibniz. These are Molina’s theory of middle knowledge, the Thomist theory of foreknowledge through divine predeterminations, and Leibniz’s own ‘possible worlds’ theory. The paper concludes that no consistent theory of divine foreknowledge emerges (...) in Kant’s philosophy. His discussions alternate between two inadequate and incompatible models. One is a post-volitional model suggested by his conception of the intuitive intellect’s relation to creation. Extended to creaturely free action, it is incompatible with his commitment to the relative autonomy of free action. The other is a version of Leibniz’s possible worlds solution; it cannot underwrite certain foreknowledge of determinate outcomes in a libertarian setting. (shrink)

In this Handbook twenty-six leading scholars survey the development of philosophy between the middle of the sixteenth century and the early eighteenth century.

Kant’s Critique of Pure Reason (KrV) presents a priori knowledge of synthetic truths as posing a philosophical problem of great import whose only possible solution vindicates the system of transcendental idealism. The work does not accord any such significance to a priori knowledge of analytic truths. The intelligibility of the contrast rests on the well-foundedness of Kant’s analytic–synthetic distinction and on his claim to objectively or correctly classify key judgments with respect to it. Though the correctness of Kant’s classification is (...) vital to his philosophical project, it has been vigorously challenged since he introduced his famous distinction of judgments. The aim of this essay is to explore several metaphysical motives contributing to Kant’s objective classification claim that have been underemphasized and in part overlooked in the large literature on the topic. This book analyses the concept of scientific explanation developed by French disciples of Descartes in the period 1660-1700. Clarke examines the views of authors such as Malebranche and Rohault, as well as those of less well-known authors such as Cordemoy, Gadroys, Poisson and R'egis. These Cartesian natural philosophers developed an understanding of scientific explanation as necessarily hypothetical, and, while they contributed little to new scientific discoveries, they made a lasting contribution to our concept of explanation--generations of scientists in subsequent centuries (...) followed their lead. In times of transition and transformation, legal images metastasize. This idea can be usefully related both to Winnicott’s theory of transitional objects and Barthes’ theory of myth. But each tell only part of the full story. Barthes fails to fully account for the stabilizing effect of the reassuring signifier; Winnicott fails to fully account for the ideological adaptability—and implications—of the shifting signified. The legal image unites the iterability of the signifier and the polysemy of the signified, harnessing the affective intensity (...) of the former to the cultural mobility of the latter. In this article, I propose to illustrate this insight by reflecting on two notable images of law that appeared at a moment of profound legal transformation, at the dawn of the early modern era. The images of ‘blind justice’ and ‘sol justitiae’ which the article discusses are both ‘transitional myths’, facilitating through modes of affect a legal journey into uncharted territory. Paying attention to these images and above all to their transformation over time, we can observe not only the process of legal transition at work, but the function of the image in its authorization and modalization. The intent of the present work is chiefly the presentation of a running commentary, preponderantly historical in complexion, on the detail of the text of St. Anselm's dialogue De Grammatico. At the same time the making intelligible of that text has demanded the concurrent proffering of logical elucidations. The framework adopted for the latter is the Ontology of S. Lesniewski. The unsuitability of other current systems of logic for the analysis of medieval doctrines has been suggested in HLM I. Hereunder (...) the line of analyses proposed in HDG (an introduc tory study of De Grammatico) will for the most part be maintained, with only a few modifications. Changes which further study might demand would in any case involve not so much an abrogation of the HDG ver sions, but rather certain complications of detail on the lines indicated in HLM, HEE, and Hoi. Readers who happen to be out of sympathy either with modem logic as a whole, or with the Lesniewskian systems in particular, may be assured that the historical thread of the commentary remains for the most part unaffected by issues connected with such logics. Much of the historical material contained in the commentary consists of quotations from the logical works of Boethius. Some of that material may at first sight appear prosaic and tedious. (shrink)

This study examines the representation of male and female musicians in world-class symphony orchestras. Personnel of 40 orchestras of three regions, UK, Europe and the USA and distributions of men and women across the four orchestral departments: strings, woodwind, brass and percussion are compared. Significant differences in representation between orchestras of the three regions are reported. Practices adopted by orchestras when appointing musicians to vacant positions are reviewed and numbers of males and females appointed to rank-and-file and Section Principals are (...) compared. Career patterns of male and female musicians are also compared. Increases in numbers of women appointed to orchestral posts in the last three decades are compared with increases in the proportion of women in the general workforce. The data of orchestral membership are then compared with the numbers of young people receiving tuition on orchestral instruments retrieved from a large national database (n = 391,000 students). Implications for the future of male and female representation in orchestral personnel are then considered. (shrink)

Despite its public visibility and impact on policy, the activity of expert communication rarely receives more than a passing mention in codes of scientific integrity. This paper makes the case for an ethics of expert communication, introducing a framework where expert communication is represented as an intrinsically ethical activity of a deliberative agent. Ethical expert communication cannot be ensured by complying with various requirements, such as restricting communications to one's area of expertise or disclosing conflicts of interest. Expert communication involves (...) morally laden trade‐offs that must be weighed by a deliberative agent. ABSTRACT Recent police brutality has reminded people in the United States of America that racism and discrimination toward Black Americans is still prevalent. Evidence supports the claim that many Black Americans experience racial trauma due to the relatively common occurrence of discriminatory racial encounters in their life. Racial traumas are events of danger related to real or secondary experiences of racial discrimination that may cause psychological, emotional, or physical injury. The goal of this article is to identify the ethical complexities (...) for psychologists in addressing racial trauma among Black Americans. First, the article describes examples of racial traumas for Black Americans and their impact on overall mental health. Second, there is an in-depth analysis of ethical issues for psychologists relevant to racial trauma in areas such as competency, discrimination and harassment, bias, assessment, training programs, and harm. Finally, recommendations for psychologists are provided to address racial trauma among Black American clients, students, supervisees, and colleagues. (shrink)

George Berkeley was a university teacher, a missionary, and later a Church of Ireland bishop. The over-riding objective of his long philosophical career was to counteract objections to religious belief that resulted from new philosophies associated with the Scientific Revolution. Accordingly, he argued against scepticism and atheism in the Principles and the Three Dialogues; he rejected theories of force in the Essay on Motion; he offered a new theory of meaning for religious language in Alciphron; and he modified his earlier (...) immaterialism in Siris by speculating about the body's influence on the soul. His radical empiricism and scientific instrumentalism, which rejected the claims of the sciences to provide a realistic interpretation of phenomena, are still influential today. This edition provides texts from the full range of Berkeley's contributions to philosophy, together with an introduction by Desmond M. The temptation in clinical research to sacrifice the interests, the health, and sometimes even the lives of research subjects to the advancement of the interests of science and society, and to the advancement of researchers' own careers, is a hardy weed which can grow anywhere. Pursuant to a commendable EU Directive a new law, the Medicines for Human Use Regulations 2004 was brought into effect in the UK. That law makes it illegal for anyone to start a clinical trial unless (...) a Research Ethics Committee has expressed a favourable opinion upon its protocol. It gives to Research Ethics Committee members the legal power, and imposes upon them the legal duty, to protect research subjects from those who have strong financial and other temptations to mistreat them. The new law specifies what standard of protection the Research Ethics Committee members shall insist upon. The Royal College of Physicians, which has been reluctant to declare its own conflicting interests, in 2007 issued some guidelines which it hopes Research Ethics Committee members will follow. Those Guidelines on the practice of ethics committees in medical research with human participants urge Research Ethics Committee members to express a favourable opinion of clinical trials which they believe, for example, do not give to research subjects the protection the new law demands. But Research Ethics Committee members have a clear legal duty not to follow any course of conduct calculated to subvert the excellent and necessary 2004 law. (shrink)
